Accidents at sea

Not many cruise ships or ferries sink whilst at sea (though it has happened), but accidents certainly still occur at sea, usually caused by on board failures. Poor ship maintenance, failure to observe health & safety procedures, poor staff training all contribute to accidents and illnesses. Accidents at sea also include embarkation and disembarkation.  Had Mr V fallen down the gangplank from a cruise ship instead of down the steps attached to the aircraft, he would have claimed under the Athens Convention or the home grown Package Travel Regulations 1992.

These regulations apply if you book a cruise as part of a package.  The cruise company or tour operator can be held responsible.

Mr & Mrs F-S had looked forward to their Mediterranean cruise for months.  All was going well until the ship was in Greek waters when there was an outbreak of food poisoning on the ship, although no-one knew why.  Poorly for several weeks afterwards, they claimed.  The owners of the cruise ship, through whom they had originally booked, were liable.

The Athens Convention allows you to choose your jurisdiction and your choice will depend on a number of factors.  It’s usually better however to proceed under the 1992 regulations, as compensation may be higher here and your costs will be repaid if you win.  This may not be the case elsewhere.  As with air accidents, you have 2 years to claim under the Athens Convention (3 years in English law).
